The amended E-Privacy Directive or "Cookie Law" requires that those placing tracking technology on a device must "clearly" tell people that the technology is there, explain what it does and obtain consent to use it. In the UK this directive will come into force in May this year, so now is the time to be thinking about the implications for your business. So what can you do?
Start by conducting an audit. Identify the systems you use and the level of intrusiveness that results. What cookies can you stop using? What do you tell users? How do you obtain consent?
In addition to the "Cookie Law" some other major changes to data protection law are underway. In recent weeks new draft European regulation has been announced and headline proposals at this stage include broadening the scope of current legislation, increasing fines and a much tougher approach to consent, the requirement to have a data protection officer in larger businesses, faster notification of breaches and requirements regarding data portability along with an individual's ‘Right to be Forgotten’.
